The Ombudsman received a complaint about closed meetings held electronically by council for the Municipality of Temagami on March 8, 2021 and March 25, 2021.
The Ombudsman received a complaint about closed meetings held electronically by council for the Municipality of Temagami on March 8, 2021 and March 25, 2021. The complaint alleged that the resolution to proceed in camera was not passed during an open portion of either meeting. The Ombudsman found that council contravened the Municipal Act, 2001 by failing to ensure the public could observe the passage of the resolution to proceed in camera on March 8, 2021 and March 25, 2021.
The complaint also alleged that during the meeting on March 8, 2021, council’s resolution to proceed in camera did not provide a general description of the matter to be discussed and that the matters discussed in camera did not fit into any of the exceptions under the Act. The Ombudsman found that the resolution passed by council adequately provided a general description of the matter to be discussed in camera. The review also found that council’s in camera discussion fit within the exception for solicitor-client privilege.
